Terms of Service
Terms you agree to when using the Word Cards app and the wordcards.app website.
1. Parties and acceptance
These Terms of Service govern your use of the Word Cards mobile app and the wordcards.app website (together, the “Service”). By downloading, using, creating an account, or purchasing premium features, you confirm that you have read, understood, and accepted these terms in full. If you do not agree, do not use the Service.
2. Description of the service
Word Cards is an educational tool that helps you learn foreign-language vocabulary and expressions through flash cards, quizzes, spaced repetition, custom lists, notifications, cloud backup, and premium features. It is not a school, examination body, official certification provider, advisory service, or guarantee of professional education outcomes. Content, features, pricing, ad model, premium scope, and availability may be changed, limited, or discontinued without prior notice.
3. Account and sign-in
Accounts may be created through Sign in with Apple, Sign in with Google, email, or other supported sign-in methods. You are responsible for your account, linked credentials, and session security on your device. You may not transfer, rent, sell, or share your account. We may suspend or close your account in case of suspicious activity, breach, or security risk.
4. Acceptable use
You may use the Service only for personal and educational purposes and in compliance with applicable law and these terms. The following are strictly prohibited:
- Reverse engineering, decompiling, disassembling, bypassing security measures, disabling license/subscription checks, or similar technical interference
- Accessing the app database, content packages, audio files, API endpoints, Supabase infrastructure, or other technical resources outside the app in an unauthorized, automated, fraudulent, or abusive manner
- Copying, reproducing, extracting, scraping, exporting, distributing, reselling, or using the content, vocabulary database, audio, design, brand assets, screens, or software for a competing or similar product without permission
- Using bots, crawlers, scripts, automation, load testing, or similar tools to overload infrastructure, mine data, or exploit vulnerabilities
- Acting in a misleading, fraudulent, unlawful, abusive, or harmful way toward other users, third parties, store/platform providers, or Word Cards infrastructure
5. Breaches, enforcement, and damages
If you violate these terms, our intellectual property rights, technical security measures, or third-party rights, we reserve the right to suspend or close your account, block access, notify relevant stores/platforms, take technical measures, pursue civil and criminal remedies, and recover all direct/indirect losses, lost revenue, investigation and remediation costs, and reasonable legal/advisory fees.
Unauthorized copying, disclosure, commercial use, reverse engineering, scraping, unauthorized API access, or circumvention of security measures involving the app, database, audio packages, brand/design assets, or infrastructure is considered a material breach. For such breaches, we may seek injunctive relief, access blocking, damages, disgorgement of unlawful gains, and criminal complaints where available under applicable law.
6. Premium subscriptions, ads, and payments
- Premium subscriptions are purchased and billed through the Apple App Store and Google Play; RevenueCat may be used for payment and subscription verification. Payments are processed by the relevant store.
- Subscriptions renew automatically at the end of each period unless cancelled. You may be charged unless you cancel at least 24 hours before the current period ends.
- You cancel from your App Store or Google Play account settings. Refund requests are entirely subject to the relevant store’s policies; Word Cards makes no refund commitment.
- When AdMob is enabled, ads may be shown in the free version. Ad delivery, personalization, and consent preferences are handled under the Privacy Policy and applicable platform rules.
- Prices, promotions, ad model, free/premium limits, and plan contents may change without prior notice. After cancellation, you keep access to premium features until the end of the current period.
7. Intellectual property
All content, vocabulary and expression databases, example sentences, definitions, audio files, software, code, algorithms, designs, screens, trademarks, logos, icons, images, text, data structures, and compilations in the Service belong to Word Cards or its licensors and are protected by copyright, trademark, database, trade secret, and other intellectual property laws. You receive only a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable right to use the Service. This does not transfer ownership or grant commercial use rights.
8. User content and feedback
Custom lists, preferences, and similar user data you create in the app remain yours; however, we may process them to provide, back up, sync, secure, and improve the Service. Any feedback, suggestions, or ideas you send us may be used to improve the product without payment or obligation to you.
9. Disclaimer of warranties (“as is”)
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. Word Cards and its publisher make no warranties of any kind, whether express or implied. We make no promise, commitment, or warranty as to accuracy, completeness, timeliness, fitness for a particular purpose, non-infringement, uninterrupted operation, security, error-free operation, ad-free availability, no data loss, or compatibility with every device, among others.
10. No guarantee of results
Word Cards is a learning tool. Language learning, vocabulary improvement, success in any exam, certification, or any academic, professional, commercial, or other outcome is not guaranteed in any way. Results depend entirely on your own effort, usage, consistency, prior knowledge, and individual circumstances.
11. User responsibility and assumption of risk
Your decision to use the Service, how you use it, and any decisions made in reliance on content, translations, examples, pronunciation, definitions, or suggestions are entirely your responsibility. You are responsible for assessing whether the content fits your purpose. You accept risks arising from your use of the Service, incorrect or incomplete learning, your device, internet connection, third-party accounts, and store/platform settings.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Word Cards and its publisher shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages, including loss of data, loss of progress, device/app issues, loss of profit or revenue, reputational harm, lost educational/exam/job opportunity, or third-party service interruption, even if advised of the possibility of such damages. In any case, our total liability is limited to the subscription amount, if any, you paid us in the 12 months preceding the relevant claim. For free users, our total liability is limited to the lowest amount permitted by applicable law.
13. Waiver of claims, class action waiver, and disputes
To the extent permitted by applicable law, you may bring claims arising from the Service only in your individual capacity and may not participate in a class action, representative action, class arbitration, or similar collective proceeding. Except for mandatory non-waivable consumer rights, by using the Service you waive claims against Word Cards and its publisher to the extent such waiver is legally permitted. Nothing in these terms is intended to remove rights that cannot be waived under mandatory law.
14. Third-party services
The Service relies on third-party services such as Apple, Google, Supabase, Firebase, AdMob, RevenueCat, Expo, and similar providers. Word Cards is not responsible for their availability, interruption, failure, data loss, pricing/policy changes, store decisions, ad serving, or subscription verification. Those providers’ own terms and privacy policies also apply.
15. Indemnification
You agree to indemnify and hold harmless Word Cards, its publisher, employees, representatives, and partners against any claim, lawsuit, damage, penalty, cost, attorney fee, and advisory fee arising from your use of the Service in breach of these terms, applicable law, third-party rights, or platform rules; misuse of your account; unauthorized copying, reverse engineering, data extraction, API/infrastructure abuse, subscription/payment manipulation, fraud, or security breach.
16. Changes, suspension, and termination
We may modify, limit, suspend, or discontinue the Service, content, limits, pricing, ad model, premium scope, or any feature without prior notice. We may suspend or close your account due to breach, abuse, security risk, unlawful behavior, payment/subscription issue, or platform policy. You may request account closure/deletion in the app or by emailing support@wordcards.app.
17. Governing law and jurisdiction
These terms are governed by and construed in accordance with the laws of the Republic of Türkiye. Subject to mandatory consumer protection laws, the courts and enforcement offices of the Republic of Türkiye have jurisdiction over disputes arising from these terms or the Service.
18. Changes to these terms
We may update these terms at any time. For significant changes, we may notify you in the app, on the website, or by email. Continuing to use the Service after changes take effect means you accept the updated terms. The current version is always published on this page.
